DMCA Policy for Spanish Rice

Spanish Rice ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Spanish Rice service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.

Filing a DMCA Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

  1. Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail to identify the copyrighted work(s) infringed (e.g., a link to the original work or a copy of the work).
  2. Identification of the material that is claimed to be infringing: Provide a description of the material on the Spanish Rice website that you claim is infringing, with enough detail so that we may locate it. A URL is generally required.
  3. Contact information of the complaining party: Provide your name, mailing address, telephone number, and email address.
  4. A statement that the complaining party has a good faith belief: State that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate: State that, under penalty of perjury, the information in the notification is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. An electronic or physical signature: Provide an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.

Filing a DMCA Counter-Notification

If your content was removed pursuant to a DMCA notification and you believe that the content was removed by mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent. Upon receipt of a valid counter-notification, we will forward it to the complaining party. If the complaining party does not file a court action seeking a court order to restrain the counter-notifying party from engaging in infringing activity within 10-14 business days, we may restore the removed content.

  • Identification of the material that has been removed: Identify the specific URL(s) or description of the content that was removed or disabled.
  • A statement under penalty of perjury: State, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your contact information: Provide your name, address, telephone number, and email address.
  • Consent to jurisdiction: State that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the U.S., for any judicial district in which Spanish Rice may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature: Provide your physical or electronic signature.
